DMCA Notice and Takedown Procedure

GameDay DJ respects the intellectual property rights of others and expects users of our service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. §512, we will respond to claims of copyright infringement committed using our service that are reported to our Designated Copyright Agent.

If you believe content available through GameDay DJ infringes your copyright, you may request its removal by submitting a written notice that contains the information described below.

Our agent is registered with the U.S. Copyright Office. To verify, search the Copyright Office DMCA Directory for "GameDay DJ".

Submitting a Notice of Claimed Infringement

To be effective under the DMCA, your notice must be a written communication that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list of such works).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, with information reasonably sufficient to permit us to locate the material. Please be as specific as possible — include the email address of the user who uploaded the file (if known), the approximate upload date, and a description of the audio in question.
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Our Response

Upon receipt of a notice that substantially complies with the DMCA requirements above, we will:

Counter-Notification (Reinstatement)

If you are a user whose content was removed because of a DMCA notice, you may file a counter-notification if you believe the material was removed as a result of mistake or misidentification. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the complainant or their agent.

Submit counter-notifications to the same address as DMCA notices: dmca@getgamedaydj.com.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and inform them that we may restore the removed material within 10 to 14 business days unless they file an action seeking a court order against the user.

Repeat Infringer Policy

It is our policy to terminate the accounts of users who are determined to be repeat infringers. We will, in appropriate circumstances and at our discretion, terminate or suspend a user's access to GameDay DJ following multiple DMCA takedown notices substantiated against the same user.

Misuse Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by us, by any copyright owner or its licensee, or by a user who is injured by our reliance upon such misrepresentation. Do not submit a DMCA notice unless you have a good faith belief that the material in question infringes your rights.

Personal-Use Content Imported by Users

GameDay DJ offers users the ability to import audio files (such as personally-recorded announcer intros or audio they have licensed for personal use) into their My Studio library. Before any audio file can be imported into the service, the user must explicitly confirm that they have the right to use the audio in question. We do not analyze, fingerprint, or catalog the source of user-uploaded audio.

If you are a rights holder and you believe that user-uploaded content on our service infringes your rights, please use the DMCA notice procedure above. We will respond promptly to all valid notices.
